AIR CHARTER TERMS
The terms under which ESCAPE arranges private air charter for its clients.
Who we are
ESCAPE is a trading name of Escape Productions LLC, a California limited liability company, PO Box 715, Pioneertown, CA 92268. These terms apply whenever ESCAPE holds out, sells or arranges private air charter for a client (the “charterer”). They sit alongside our general Terms and any written booking confirmation, which takes precedence if the two differ.
Air charter broker
ESCAPE is an air charter broker. ESCAPE is not a direct air carrier or a direct foreign air carrier, does not own or operate aircraft and is not in operational control of any flight. All air transportation we arrange is provided by a properly licensed direct air carrier.
Licensed operators only
We arrange single-entity charter only with direct air carriers that hold the economic authority required by the U.S. Department of Transportation and the appropriate safety authority from the Federal Aviation Administration, typically operators certificated under 14 CFR Part 135, and, where applicable, a foreign safety authority. We do not arrange transportation that the operator is not itself authorised to hold out, sell or operate.
The capacity in which we act
Unless we tell you otherwise in writing, ESCAPE acts as the agent of the charterer. The capacity in which we are acting is confirmed in writing before any booking.
What we disclose before you book
Before you enter into a contract for a flight or series of flights, we will tell you in writing: the corporate name of the direct air carrier in operational control of the aircraft, and any other names under which it holds itself out to the public; the capacity in which ESCAPE is acting; and whether ESCAPE holds liability insurance covering the charterer, passengers and property on the flight, and if so its monetary limits.
What we disclose on request
On request, before you book, we will also tell you: any corporate or business relationship between ESCAPE and the operator, including any pre-existing contract, that may bear on our choice of operator; the total cost of the air transportation paid to or through ESCAPE, including any broker or carrier fees and government taxes and fees; and any fees collected by third parties, with their amounts if known or a good-faith estimate if not, such as fuel, landing, parking or hangar fees, that you will pay directly.
If information changes
If any of this information is not known when you book, or changes afterwards, we will give it to you within a reasonable time so that you can decide whether to accept it. If we do not, you may cancel and receive a full refund of all money paid for the charter and any related services. In every case you will have this information before the flight begins. If anything changes once travel has begun, we will tell you within a reasonable time; if we do not, you may cancel the remaining portion and receive a full refund for the transportation and services not yet provided.
Quotes, payment and the operator’s terms
Quotes are subject to aircraft and crew availability until confirmed in writing. The booking confirmation sets out the price, payment schedule and cancellation terms. Each flight is also subject to the operator’s own conditions of carriage, which we provide with the confirmation and which govern carriage on the aircraft.
Refunds
When a charter cannot be performed, or a refund is otherwise due, we refund promptly: for credit card purchases, as required by 14 CFR 374.3 and 12 CFR part 226; for cash and cheque purchases, within 20 days of receiving a complete refund request.
Safety, weather and delays
The operator and the pilot in command have final authority over every flight, including whether, when and where it operates. Flights may be delayed, diverted or cancelled for weather, air traffic control, maintenance or safety reasons. Helicopter landings on private property are made only where the operator approves the site and conditions.
Passengers and baggage
Passengers must carry valid identification and any travel documents required for their journey, and follow the instructions of the crew. Baggage limits depend on the aircraft and are confirmed before departure. Hazardous materials, weapons and other items prohibited by the operator or by law may not be carried. Pets travel only with the operator’s prior approval.
Liability
The operator is responsible for the operation of the aircraft and for the carriage of passengers and property. To the extent permitted by law, ESCAPE is not liable for the acts or omissions of the operator or of other third parties, or for indirect or consequential loss. Nothing in these terms limits any liability that cannot lawfully be limited, or any rights you have under 14 CFR Part 295.

Governing law
These terms are governed by the laws of the State of California and applicable U.S. federal law, including 14 CFR Part 295.
